That distinction matters. Many people assume shampoo bars should be classified with soap bars in HS Chapter 34. However, Note 1(c) to Chapter 34 excludes “shampoos … whether or not containing soap or other organic surface-active agents” and directs them to heading 33.05. So a shampoo bar is generally not classified under 3401.11 merely because it is in bar form.

- Use 3305.10 for solid shampoo bars, including syndet (soap-free) bars and soap-based shampoo bars that are clearly marketed for washing hair.
- Avoid classifying shampoo bars under 3401.11 simply because they are solid; that heading is for toilet soap and surface-active skin-washing bars.
- If the bar is a conditioner or co-wash without a cleansing function, consider 3305.90 instead.
- Always confirm the destination country’s 8- or 10-digit code and any applicable duty rate with a customs broker or the official tariff database before shipping.
